Haynes and Boone
The Restructuring Practice Group at Haynes and Boone is fully equipped to handle issues in large and complex out-of-court financial restructurings and Chapter 11 reorganization cases. Chambers USA, Chambers and Partners, 2018 ranks the practice as a market leader both globally and nationally, and clients describe our lawyers as “business-oriented attorneys.” Our Restructuring Practice Group was shortlisted for the 2015 Chambers USA Award of Excellence as Bankruptcy Team of the Year for the entire nation.
Our clients, whether they are debtors, creditors, lenders, equity security holders or agent banks, rely on our significant experience, skill and deep bench. With partners and counsel that have been practicing for an average of 25 years or more and a dedicated team of well-trained associates, we have the knowledge, experience, and skills to tackle our clients’ toughest problems.
Restructuring a debt-laden business is akin to multi-party military maneuvers: each creditor/party-in-interest has its own agenda, but victory generally results from forming multiple, and sometimes shifting, strategic alliances, which constantly must be re-evaluated. The attorneys in the Restructuring Practice Group have extensive experience in all aspects of insolvency practice, including representing debtors-in-possession, creditors committees, financial institutions and other secured and unsecured creditors, trustees, indenture trustees, landlords, acquirers, and equity security holders committees, both in out-of-court restructurings and in bankruptcy court. Our involvement in many significant corporate reorganizations representing different types of parties-in-interest, not just debtors or only financial institutions, provides understanding of the dynamics of the reorganization process from each constituent’s point of view. This multi-faceted, multi-billion dollar experience gives us the ability to anticipate likely developments in a restructuring which can be the catalyst for a mutually beneficial relationship between the debtor and its various creditor constituencies.
In the oil and gas space, our lawyers have a deep understanding of the day-to-day operational and financial issues impacting our clients as well as the economic and political trends that affect their businesses. Haynes and Boone has extensive experience in the energy, oil and gas, oilfield services, and petrochemical industries, which means we have been witness to the varying business cycles of the energy industry and have worked on a number of high profile debt restructurings and insolvencies on both the debtor and creditor sides.
Because of our diversity of perspective and experience, it is unlikely that our team of bankruptcy lawyers will encounter situations for which they do not have analogous experience. Having worked on cases from every side of the docket enables our lawyers to assess a client’s particular facts and circumstances, to quickly recommend alternative causes of action and to provide reasoned and well-grounded assessment of the likely success of such alternative courses. Most importantly, our experience translates into bringing value to our clients and counsel that is reliable and working in your best interests during very stressful times. We have handled matters across a wide variety of industries, and our lawyers are adept at learning the “ins-and-outs” of our clients’ businesses.
